So just got notification form the CCMA that they cannot help me with my case against my old boss… because I earn above the threshold…i had no idea that the CCMA had a limit to who they help. I now have to approach the labour court directly or go through the normal magistrate’s court. This essentially means that my boss will just ignore me completely and not pay me at all…

I at least still have possession of 2 company laptops. which i said i would only return upon payment of my outstanding salary. i also have most of the company’s intellectual property on those laptops as well.

This is so kak though… because even if i go the summons route there is no guarantee of getting any money because she will say that all the stuff at the offices belong to another company and not the one i worked at.

FYI for anyone earning above this:

“3. Section 73A (1) only applies to employees or workers who earn below the threshold prescribed by the Minister in terms of section 6(3) of the BCEA. The current threshold amount is R211 596, 30 per annum. You are currently earning above the threshold and you cannot refer a section 73A dispute to the CCMA.”

I’d give the CCMA a call to get clarification. Section 73a seems to be about getting your minimum wage paid out, not your salary as set out in your employment agreement.

I did speak to them. Because the award I want from the ccma is payment of my salary for 2 months and me earning above the threshold I wave to go directly through the labour court. The ccma has already provided me with a letter as well setting out the reasons and I have looked up on it now as well.
It’s shitty but it is what it is.

Does anyone know of a fire house that is accepting to the public to come have a look, I want to take my kids to see one.

Normally you can call your nearest one and organise with them for a time, but I’m not sure now in covid. Worst case go pop in to your nearest one and chat to them to see if you can organise.
